Terms of Use — Citerne

1. Purpose
These Terms of Use govern the use of the Citerne mobile application (the "App") published by Christopher Denis (Sole Trader, trade name: Waideline), SIREN 829 530 757, 200 rue de la Croix Nivert, 75015 Paris ("we").
The App lets its users share links, videos and articles ("drops") with their contacts, in a deferred and calm sharing logic, as an alternative to instant messaging.
2. Acceptance
Using the App entails full and unreserved acceptance of these Terms. Acceptance is materialised at sign-up and timestamped.
3. Sign-up and access
3.1 Sign-up requirements
- Be at least 16 years old.
- Have a compatible Android or iOS device.
- Authenticate via Sign in with Google, Sign in with Apple, or (where applicable) a phone number verified by OTP.
3.2 Identifier
Each user picks a public display name paired with a 4-digit discriminator for disambiguation.
3.3 Single account
A user may not hold more than one active account.
4. Use of the service
4.1 Permitted behaviour
- Sharing content for which you hold the rights or for which sharing is authorised.
- Sharing with your contacts or in channels of which you are a member.
4.2 Prohibited behaviour
The following are notably prohibited:
- distribution of unlawful content (incitement to hatred, glorification of terrorism, child sexual abuse material, counterfeit, defamation, breach of privacy…);
- harassment and spam;
- identity impersonation;
- any attempt to circumvent technical limits (rate limiting, OTP fraud, vulnerability exploitation);
- automated data extraction (scraping);
- unauthorised commercial use.
5. Moderation and reporting (DSA)
In accordance with the DSA:
- Any user may report content from within the App.
- Reports must identify the content concerned, explain why it is considered unlawful, provide a means of contact except where a legal exception applies, and confirm the good faith of the report.
- We acknowledge receipt when a means of contact is provided, then handle reports in a diligent, objective and non-arbitrary manner.
- Moderation decisions (content removal, account suspension) are reasoned and notified to the user concerned.
- An internal appeal is available by replying to
legal@waideline.com.
Possible sanctions, graduated according to severity:
- Warning.
- Removal or restriction of the reported content.
- Temporary suspension.
- Permanent account deletion.
6. User content
You remain the owner of the content you publish. By publishing it, you grant us a non-exclusive, worldwide, royalty-free licence, limited to the duration of the service and strictly necessary for:
- storage and transmission to the recipients you have chosen;
- generation of previews (title, thumbnail, duration);
- technical back-ups.
This licence ends upon deletion of the content or of your account for any new processing, save for a legal retention obligation (reports, fraud). Content already delivered to the recipients you had chosen may however remain accessible under a "Deleted account" profile in order to preserve the integrity of past exchanges.
7. Personal data
The processing of your personal data is governed by our Privacy Policy, available at https://citerne.waideline.com/privacy.
8. Availability
The service is provided "as is", without any guarantee of uninterrupted availability. We strive to maintain a reasonable quality of service but cannot guarantee the absence of maintenance, outages or occasional unavailability.
9. Account deletion
You can delete your account at any time from Profile → Delete my account. Purely personal data is deleted or anonymised immediately: tokens, devices, contacts, channel memberships, reservoir and personal moderation signals are deleted server-side. Some content already delivered to recipients may remain visible under a "Deleted account" profile in order to preserve the integrity of past exchanges. See Privacy Policy §4 for the details.
10. Suspension by us
We reserve the right to suspend or delete an account in case of a breach of these Terms, after a reasoned notification, except in case of urgency (security incident, authority report).
11. Liability
We cannot be held liable for content published by users. In accordance with Article 6 of the French LCEN, our hosting provider liability is engaged only from the moment we become aware of manifestly unlawful content and only if we fail to take it down diligently.
12. Changes to the Terms
Any material change will be notified to you 30 days before it enters into force. Continued use after that date constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by French law, without prejudice to the mandatory more protective provisions applicable to the consumer in their country of habitual residence within the European Union (Rome I Regulation, Art. 6).
Any dispute is in principle subject to the jurisdiction of the French courts; however, in accordance with Article 18 of the Brussels I bis Regulation, the consumer may also bring the case before the courts of the Member State where they are domiciled.
